1. Introduction

Welcome to Eyevary Store, operated by Eyevary Limited (“Eyevary,” “we,” “our,” or “us”). Eyevary Store is an online platform facilitating the sale of products and services to individual customers (“Individual Buyers”) and businesses or organizations (“Business Buyers”). Collectively, they are referred to as “Buyers.”

By accessing the platform, placing an order, or purchasing products or services through Eyevary Store, you agree to these Terms & Conditions.

2. Orders and Acceptance

All orders are subject to product or service availability, pricing confirmation, and acceptance by Eyevary. Placing an order does not automatically guarantee acceptance.

We reserve the right to reject or cancel an order for legitimate reasons, including stock shortages, pricing or listing errors, suspected fraud, or other circumstances that prevent fulfillment. Buyers will be notified of any cancellation affecting their orders, and applicable refunds will be processed in accordance with our refund policy and applicable law.

3. Pricing and Payment

Prices are displayed in the currency specified on the platform and may exclude applicable taxes, VAT, delivery charges, or other fees unless otherwise stated.

Buyers must complete payment using the payment methods available at checkout or other methods agreed upon with Eyevary. Orders may be processed after payment confirmation or in accordance with agreed payment terms.

Eyevary reserves the right to correct pricing errors and notify affected Buyers before proceeding with an order. Any additional charges must be communicated to the Buyer before payment or order confirmation, as applicable.

4. Delivery and Returns

Delivery timelines are estimates and may vary depending on product availability, delivery location, logistics, and other circumstances beyond our reasonable control.

Buyers should inspect delivered products and report any damage, defect, missing item, or incorrect delivery within a reasonable period after receipt.

Order cancellations, returns, replacements, and refunds will be handled according to the applicable product or service policy and the laws of Bangladesh. Nothing in these Terms & Conditions limits any mandatory consumer rights under applicable law.

Digital products, software licenses, customized solutions, and services may be subject to specific delivery, cancellation, refund, or licensing conditions disclosed before purchase.

5. Buyer Responsibilities

All Buyers must provide accurate contact, billing, delivery, and order information and use Eyevary Store lawfully.

Individual Buyers are responsible for providing accurate personal information and using purchased products or services in accordance with applicable laws and relevant product instructions.

Business Buyers are responsible for ensuring that purchases are made by authorized representatives and that products or services are used in accordance with applicable contractual, licensing, and organizational requirements.

Neither Individual Buyers nor Business Buyers may misuse the platform, submit fraudulent orders, interfere with its operation, or engage in unlawful activities.

6. Intellectual Property

All content on Eyevary Store, including trademarks, logos, website design, text, graphics, images, and software, belongs to Eyevary Limited or its respective licensors or manufacturers unless otherwise stated.

Buyers may not copy, reproduce, modify, distribute, or commercially exploit Eyevary's intellectual property without prior written permission.

Purchasing a product or service does not transfer ownership of Eyevary's intellectual property. Software products and digital services may be subject to separate license agreements.

7. Product Information and Third-Party Products

Eyevary makes reasonable efforts to ensure that product descriptions, specifications, images, availability, and prices are accurate. Minor variations may occur between product images and actual products.

Where products or services are supplied by third parties, additional manufacturer warranties, license terms, or service conditions may apply. Any applicable third-party terms will be communicated where reasonably necessary.

Eyevary does not guarantee third-party products or services beyond the warranties or commitments expressly provided by Eyevary or required by applicable law.

8. Limitation of Liability

Eyevary will make reasonable efforts to maintain the availability and proper functioning of Eyevary Store. However, uninterrupted or error-free access cannot be guaranteed.

To the extent permitted by applicable law, Eyevary shall not be liable for indirect or consequential losses arising from the use of the platform, delays beyond its reasonable control, or circumstances attributable to third parties.

Nothing in these Terms & Conditions excludes or limits liability, warranties, or consumer rights that cannot lawfully be excluded or limited under applicable law.

9. Privacy and Data Protection

Eyevary respects the privacy and confidentiality of Buyers' personal and business information. Information collected through Eyevary Store will be processed in accordance with our Privacy Policy and applicable data protection laws.

Buyers are encouraged to read our Privacy Policy to understand what information we collect, how we use it, and when it may be shared with authorized service providers or other parties.

10. Changes, Suspension, and Termination

Eyevary may update these Terms & Conditions from time to time by publishing a revised version on the platform and indicating the updated date.

Changes will apply as permitted by applicable law. Where required, Buyers will be notified of material changes before they take effect.

Eyevary may suspend or restrict access to the platform where reasonably necessary due to suspected fraud, unlawful activity, security risks, or violations of these Terms & Conditions.

Such action will not remove any rights or obligations that have already accrued or any mandatory rights available to Buyers under applicable law.

11. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by the laws of Bangladesh.

In the event of a dispute, the parties should first attempt to resolve the matter amicably through direct communication. If the dispute cannot be resolved amicably, it may be referred to the competent courts of Bangladesh, subject to applicable law.
